What is a MUD tax in Texas?

A MUD tax is a property tax levied by a Municipal Utility District — a local district created to finance water, sewer, and drainage infrastructure in newer Texas developments where city services don’t reach. The tax appears as its own line on the property tax bill, and rates commonly decline as the district’s construction debt is paid down.

Why MUDs exist

Much of Texas’s suburban growth happens outside city limits, where no city utility system exists to extend. A Municipal Utility District is a political subdivision of the state, created under the Texas Water Code, that can issue bonds to pay for the water, sewer, and drainage infrastructure a new community needs. The homes in the district then repay that infrastructure debt through the district’s own property tax, on top of the county, school district, and any other taxing units on the bill. Master-planned communities such as Trinity Falls in McKinney follow this pattern.

What happens to the rate over time

A young district carries the full weight of its construction bonds with relatively few homes to spread it across, so early tax rates are typically at their highest. As the community builds out and the bond balance is paid down, the rate commonly declines. That trajectory is a pattern, not a promise — the district’s board sets the rate each year based on its debt and operating costs — so a buyer should look at the district’s current rate and outstanding debt, not just the direction rates usually move.

The statutory notice a seller must give you

Texas law treats the MUD tax as a fact a buyer must be told, not one they should have to discover. Under Texas Water Code §49.452, a seller of property inside a Municipal Utility District must deliver a written notice disclosing that the property is in the district, along with the district’s tax rate and bonded indebtedness, before the sale closes. Read it when it arrives: together with the county appraisal district’s tax records, it tells you exactly what the district line on your future tax bill is based on.
